MOONSIGHTING – THE WAY FORWARD

Every Muslim in his heart wishes that there should be unity amongst Muslims. This is true. However, below are some guidelines pertaining to unity on the moonsighting issue:

(1) We may strive for unity, but not at the expense of compromising the Shariah.

(2) The Shariah clearly states that we have to look for the moon with the naked eye. Astronomical calculations are rejected by the Shariah. The views of astronomers, scientists and all other moonish characters are not valid for determining the new moon. There is only one method: Sighting the moon with the naked eye. The birth of the moon and scientific evidence are not considered and
are of no significance in this matter.

(3) Here in South Africa, we do not accept any sightings from any other country. It is unintelligent to seek unity with Zimbabwe, Saudi Arabia, etc. but at the same time cause dissension and disunity within one’s own country. Furthermore, it is difficult to ascertain the reliability of a report from an outside country.

(4) The Shariah stipulates that only the testimony of aadil persons be accepted in the process of confirming the sighting of the Hilaal, not only Ramadhaan and Shawwaal, but for all the Islamic months. In this regard the Books of the Shariah state: “The testimony of an aadil shall be accepted according to Abu Hanifah” (Badaaius Sanaa’, Vol.2, page 81)

“Adaalah is stipulated as a condition (for accepting of testimony pertaining to sighting the Hilaal) because the statement of a faasiq in matters of the Deen is unacceptable…” (Hidaayah, Vol. 1)

A faasiq is one who flagrantly transgresses the laws of Allah Ta’ala. One who neglects his Fardh Salaat; one who does not regularly perform his Salaat in jamaat; one who wears short trousers exposing his thighs in public; one who shaves or cuts his beard and one who generally indulges in sin openly is termed a faasiq.

By way of example, we cannot accept news from Mufti Menk as he is a Faasiq. He openly violates the Shariah, takes photos with women, does not make proper Hijaab, photos, Facebook, etc.

Aadil in the context of Shar’i Shahaadat (testimony) refers to a person in whom there is the quality of Adaalah. What is the meaning of Adaalah in the Shariah? The Books of Islam define Adaalah as follows:

“The meaning of Adaalah is the ability (or attribute) which brings about the state of permanent Taqwa and culture (in the Muslim). The minimum requirement for Adaalah is abstention from major sins and (abstention) from habitual commission of minor sins as well as from such acts which are negatory of culture (murawwah or good Islamic moral behaviour).” (Bahrur Raaiq and Shaami)

Thus, according to the Shariah an aadil person is one who abstains from major sins; does not habitually commit minor sins and does not indulge in lowly acts of disrepute–acts which are unbecoming of the dignity of a Mu’min. The following are some khilaaful murawwah (contrary to culture and dignity) acts:

  • Eating in the Street.
  • Walking in public bare-headed.
  • Walking in public with elbows exposed such as those who don short-sleeved shirts and sweaters in public.
  • Urinating in public places such as public urinals in full view of others as is the style of the western kuffaar.
  • Any acts which although not sinful, nevertheless are bemeaning to the honour and dignity of a Mu’min.

The Shariah stipulates that only the testimony of aadil persons be accepted in the process of confirming the sighting of the Hilaal, not only Ramadhaan and Shawwaal, but for all the Islamic months. In this regard the Books of the Shariah state:

“The testimony of an aadil shall be accepted according to Abu Hanifah” (Badaaius Sanaa’)

“(The testimony) will be accepted if the testifier is an aadil” (Fataawa Aalamghiri, Vol. 1, page 197)

“His testimony will be accepted when he is an aadil” (Mabsoot of Sarakhsi, Vol. 2, page 139)

(5) Confirming the moon for Ramadaan:

A – When the sky is clear, the sighting of a large number of persons is imperative for the confirmation of the Hilaal. The large number is called Jamm-e-ghafeer.

B – The Shariah’s ruling differs when the sky is overcast. On such occasions the report of even one pious and uprighteous (aadil) person will suffice to confirm the sighting of the Hilaal of Ramadhaan.

(6) Confirming the moon for Eid:

A – CLEAR SKIES – The Hilaal of Shawwaal is confirmed by the Shahaadat (testimony) of the sighting of a large group of people (Jamm-e-Ghafeer).

B – OVERCAST – When the sky is overcast the Shawwaal Hilaal (for Eid) will be confirmed by the sighting of two aadil (uprighteous) men or one man and two women.

(7) Shaafis: They may not accept sightings beyond the Musaafir distance! Thus, there should be no discord if Cape Town does not accept Worcester’s sighting and vice-versa! We need to understand the Shariah and respect the Math-habs. We should not behave like moron Salafis who do not follow any Math-hab, but are lost ignoramuses who merely slander the noble Imaams of the Four Math-habs and their followers.

(8) Moonsighting reports: The essential condition for the acceptance of such news is reliable transmission and receipt of the news (Tareeq-e-Moojib). Just any rumour, news, radio announcement, telephone message, etc. are not regarded as “reliable” nor are these methods of transmission regarded as Tareeq-e-Moojib for the purpose of confirming the Hilaal.

(9) There is absolutely no need to confirm a valid sighting with science or astronomy.

(10) Eid does not have to be on the same day throughout the country. If Shar’i conditions are fulfilled and Ramadhaan commences on the same day throughout the country and Eid celebrated on the same day, well and good. There is no conspiracy to impede such developments. However, there is no Shar’i incumbency for the celebration of Eid on the same day throughout the country. The Shariah has not imposed any such law on the Ummah. The commencement of Ramadhaan on the same day in every place is not commanded by the Shariah. On the contrary, the authentic Ahadith unequivocally reveal that even during the time of the Sahaabah, Ramadhaan and Eid were on different days in different places. And, this inspite of reliable and authentic sightings and reports. Yet there were no controversies on the moon issue.

MUFTI AK’S COMMENT ON RABIUL AWWAL 1438 MOON

THE MOON DEBACLE OF THE FAKE UUCSA

A needless moon controversy  was created by Fake uucsa, the NNB Jamiat and the KZN Jamiat by their refusal to abide by the Shariah when the  sighting of the Hilaal for Rabiul Awwal was confirmed by the genuine UUCSA and by  the National Hilaal Committee of S.A.. Commenting on this debacle caused by the irrational and emotional attitude of the  Fake uucsa, Mufti Abdul Kader Hoosen commented as follows:

“I am being inundated now with  messages. People want to know regarding the moon. Even last night I was receiving messages but I did not respond because I was at Darul Uloom Zakariyya Hadhrat  with Maulana Zamaan Sahib (Hafizahullah) who happened to be there.

Now let us put things in their proper perspective.  …………….    Remember the moon of yesterday after Maghrib was more than 28 hours – 28 hours and 27 minutes or something like that. So anyway it was 100 % easily visible if the horizon is clear.

Then whilst I was there at Zakariyya last night about 8:15 or 8:20, I received a message on my phone from Mujlisul Ulama and they confirmed that the moon has been sighted and I even went to Hadhrat Mufti Radahul Haq Sahib, our honourable Ustaad and Shaikh, and said:  “Hazrat Chaan hogaya he, Alhamdulillah!” (Hazrat, the moon has been conformed.) i.e. today, Jumiraat ku, will be the 1st of Rabiul Awwal and the 1st of December.

And this morning I phoned Tubela after Fajr and told him: “Tell all the people there, our presenters and so forth, that today is the 1st Rabiul Awwal.” So we accept the decision of Mujlisul Ulama. Regarding uucsa (i.e. the so-called uucsa of the NNB Jamiat of Fordsburg – Jamiat Northern Cape) and so forth, they say that they had not reached consensus. Well, that is their problem. It has  nothing to do with us. We don’t follow uucsa, and remember we are  an autonomous body and we are not bound by uucsa. We are bound by the truth.  Alhmadulillah that is what we follow.

As far as the so-called uucsa goes, they have MJC, they have Jamiatul Ulama KwaZulul Natal, they have Jamiatul Ulama Fordsburg, they have Sunni Ulama Council, Sunni Jamiatul Ulama, Eastern Cape Ulama Council, Northern Ulama Council and other bodies.

So if they have not reached conclusion, it has nothing to do with us. We follow what is the truth. The sighting took place; Mujlisul Ulama confirmed it, and we at Channel Islam International in the world accept it and today is the 1STRabiulAwwal

You know everyday I send out a tweet, and Alhmadulillah as I sent out the tweet this morning as I do every day after Fajr,  I said that today is the 1st Rabiul Awwal. So uucsa must sort out their own views, but we continue announcing that today is the 1st of Rabiul Awwal, and we will play our Juz also accordingly. Do a simple calculation.  Just go to the Arab News which I did already after Fajr, I do that every day. You go to the Arab News and Saudi newspapers and you will see there in Saudi Arabia today is the 2nd Rabiul Awwal. So if they accept that today is the 1st, Alhmadulillah. Otherwise you will have a crazy situation that tomorrow Friday according to uucsa or so-called uucsa or whatever you want to say, it will be the 1st, while in  Saudi Arabia it  will be the 3rd,  but will be the 2nd Rabiul Awwal in South Africa (according to the confirmed sighting of Mujlisul Ulama)

 How can you have 2 days difference in this day and age? Something unheard of actually. So therefore at Channel Islam International, Alhamdulillah, we are an autonomous body, we don’t take instructions from A B C, as I always say, we don’t curry favour with any person, any organisation, any politician and political party. For you, the Ummah  Muslimah, the date in South Africa today it is the 1st Rabiul Awwal 1438 as confirmed by Mujlisul Ulama and we follow their ruling in this regard.  A sighting took place so there is no need  (for dispute). Remember if you are following the Hanafi school, then that is binding and you have to accept it. This is nothing to do with politics, nothing to do with playing of games,

 Wal Haqqu wal Haqqu yuttaba’a (It is the Haqq, and the Haqq has to be (incumbently) followed!)  Remember the truth must be followed and that is what we have to do. Insha-Allah, will play this message again, one or two times so that the Ummah comes to know.

South Africa and whoever else follows South Africa, today is the 1stRabiul Awwal. We can’t be waiting for this organization and that organization to come to ‘consensus’. The Mujlisul Ulama has announced it and that is good enough for us, we  are satisfied, Alhmadulillah!

Wama Taufeeqi illa billah. May Almighty Allah give us the ability to follow the truth without fear and favour. Jazakallah khairun my brother but I have to get this message out because so many people are sending me messages.

Question:

“Mufti, you mentioned with regards to Hanafi School. Is there difference in other schools with regards to the sighting of the moon and testimonies?

According to the Shafis they have what they call : “Liqulli baladatin rooyatu hum”, i.e. Every town should go by its own sighting. But today if you take the Shafis, majority of them have left that verdict  and they follow the Hanafi School. You will see in other months also, they have 4 or 5 places of sighting, and then they accept it.  I mention particularly  the Hanafi school because in the Hanafi school  one sighting its sufficient everywhere. So therefore — and we know there was a sighting  and the Ulama of Mujlisul Ulama accepted it–  that’s fine.

So to be on the safe side I just mentioned about the Hanafi School. But today the Shafis also follow the Hanafi school, most of them. So therefore we should remember, everybody accept it Alhamdulillah. Those people or organisations who don’t want to accept it, we don’t impose upon you bhai, you can follow whatever you want to, we have confidence in Mujlisul Ulama and we follow them in this regard and I told you what unfolded the sequence of events, and I only saw these messages coming just now, so therefore I have to go on air. But not last night — only  1 to 2 messages. But now my phone is getting full I see. So many people sending messages saying that there is no consensus, well we are not interested in their consensus we say today is the 1 Rabiul Awwal 1438  Alhamdulillah!

Question

Mufti Sahib what seems to be the difference of opinion, or why consensus cannot be reached? I mean was it not straight forward like other months?

That you need to ask uucsa because they have their organisation and if one organisation says they are not satisfied then they must come on air on their radios stations or we are prepared to give them our platform and they must come and speak. I am not speaking on behalf of Mujlisul Ulama, I am just confirming that what Mujlisul Ulama did is 100 % correct, and we endorsed that Alhamdulillah!  We  have nothing to do with uucsa. We are not affiliated to them, and Alhamdulillah, we pass our own verdict so we say we agree 100% with Mujlisul Ulama. And if you don’t know who is Mujlisul Ulama, it is Hadhrat Maulana Ahmad Sadiq Desai Sahib (Hafizahullah) and his Ulama, and we have confidence on them regarding this issue and we say today is the 1st Rabiul Awwal Alhamdulillah!

SHA’BAAN 1436 – MAY 2015

The Jamiatul Ulama Northern Cape Hereby confirms that the moon for Sha’baan 1436 has been sighted with the Fadhl of Allah.

It has been sighted in the KZN, FREE STATE, NORTHERN CAPE AND OTHER AREAS AS WELL.

Tomorrow, Wednesday, will be the 1st of Sha’baan corresponding to 20 May 2015
